Human Rights: US court blocks US bid to send Egyptian home to face possible torture

Reuters reports a U.S. appeals court on Friday blocked the Bush administration's efforts to deport an Egyptian to his home country, where the government says he is wanted for murder and he claims he would be tortured.

The Third Circuit Court of Appeals upheld a lower court decision allowing Sameh Khouzam to remain in the United States pending an immigration hearing, and it allowed him to challenge Washington's assertion that he would not be tortured if deported to Egypt.

The case is the first test of the administration's use of "diplomatic assurances," which it cited as it contended that Khouzam would not be tortured if he were sent back to Egypt.
